The MPCA recently announced changes to rules governing subsurface sewage treatment systems (SSTS), more commonly known as septic systems. Specifically, the proposed rule change would require septic tanks to be pumped empty in order to complete a tank integrity compliance inspection.
This rulemaking project will amend subsurface sewage treatment system (SSTS)-related rules regarding situations where:
- A state disposal system (SDS) permit is required rather than a local permit.
- Tank pumping is required for completing a compliance inspection on an existing SSTS.
We are currently in the comment period for state agency proposed rule changes. Comments can be submitted by all interested parties, and if you would be impacted by this proposed rule change, the MPCA needs to hear from you!
Public comment on this rulemaking is open from November 12, 2019, until 4:30 p.m. on December 23, 2019.
Comments should be submitted in writing to the Office of Administrative Hearings (OAH) Rulemaking e-Comments webpage as directed in the Dual Notice. Comments may also be submitted to the OAH by other means identified in the Dual Notice.

The Minnesota Realtors® (MNR) Governmental Affairs team has been working with a Realtor® working group to draft a comment letter stating MNR’s opposition to this rule change.
Some tips for your own submissions:
- Please focus on the specific subject of this rulemaking: requiring a septic tank to be pumped empty to complete a tank integrity inspection.
- Give special attention to how this requirement could impact real estate transactions and homeowners directly.
For example: If you bought or sold a home with a septic systems and you believe this new requirement will result in the delay or cancellation of real estate transactions, or add undue expense to home buyers and sellers, explain how this would have changed your previous transaction.
